This End User License Agreement (“Agreement”) governs the use of the MA Jobs Portal (“the Portal”), an internal web application operated by M&A Industrial Construction LLC (“M&A”) at www.manda-ne.com/jobs-portal/.
1. Who may use the Portal
The Portal is provided solely to owners, office staff, supervisors and workers of M&A who have been given an individual login. It is not offered to the general public and is not sold or licensed to other companies.
2. License
M&A grants each authorized user a limited, non-transferable, revocable right to use the Portal for M&A’s business purposes: managing jobs, crews, timesheets and related records. Users may not copy, resell, reverse-engineer or use the Portal for any other purpose.
3. Accounts and security
Users are responsible for keeping their login and second-factor codes private and for all activity under their account. Accounts may be suspended or removed by M&A at any time.
4. QuickBooks connection
The Portal may read the employee list from M&A’s QuickBooks Online company, as described in the Privacy Policy. The connection is read-only and can be ended at any time by the Portal owner or by the QuickBooks company administrator. Use of QuickBooks Online itself is governed by Intuit’s own terms.
5. Fees
The Portal is provided to M&A personnel at no charge.
6. No warranty
The Portal is provided “as is” and “as available”, without warranties of any kind. M&A does not guarantee that the Portal will be uninterrupted or error-free. Timesheets and pay information recorded in the Portal are working records; official payroll is processed in QuickBooks Payroll.
7. Limitation of liability
To the fullest extent permitted by law, M&A and its contractors are not liable for any indirect, incidental or consequential damages arising from use of, or inability to use, the Portal.
8. Changes and termination
M&A may change this Agreement or discontinue the Portal at any time. Continued use after a change means acceptance of the updated terms.
9. Governing law
This Agreement is governed by the laws of the State of Nebraska, USA.
